Board Meeting Minutes
September 8, 2009

Chairman Francis Ferguson called the September meeting to order at 7:00 p.m. at the Byron Town Hall. Present were Chair Francis Ferguson, Supervisors Lowell Boelk and David Whitty, Treasurer Lois Towne and Clerk Kay Oestreich. The Pledge of Allegiance was recited.

Chair Francis Ferguson read the agenda. A motion was made by Lowell Boelk to approve the agenda as presented. David Whitty seconded the motion. Motion carried.

A motion was made by David Whitty to approve the August 11th minutes as circulated with one correction; in the paragraph regarding Ambulance Subsidy line four should be changed from $16.47 to $18.00 per person. Lowell Boelk seconded the motion. Motion carried with a vote of 3 ayes.

A motion was made by David Whitty to approve the bills as presented by the clerk with the addition of AT&T, We energy for town hall, and Cole Oil. Lowell Boelk seconded the motion. Motion carried with a vote of 3 ayes.

Permits Issued: Marlin Towne reported 5 building permits were issued in the past month.

Memorial Committee Report: Dave Whitty reported that they were having a meeting tomorrow evening. The committee needs a few more people to attend the trip, to the High Ground Memorial Park, to fill the bus. Interested persons can contact committee members.

Historical Committee Report: Tim Hackbarth reported that the committee is working on the calendar this evening. The committee is looking for pictures and other items pertaining to businesses of the town for the calendar and the open house. The next meeting of the committee is September 21st.

Decisions of Plan Committee - Board of Appeals: The clerk reported that Buechel Stone survey request had been resented.

Public Comments: Question regarding who was contracted to do road work this year and it was reported that Scotts Construction Inc had been given the bid. It was questioned if everyone received the post card informing the citizens of the meeting to consider the purchase the Betz property.

New Business:

a) Review of Budget Balances: Current balance is $144,660.15. Discussion took place on whether the town has enough funds to carry us thru the end of the year. TRIP funds will be paid after the work is complete and all bills are paid.

b) Applications for Plan Commission – Board of Appeals, Survey Maps: The public hearing regarding the Zinke Dairy Farms LLC application for the proposed livestock facility expansion will be held October 14th at the Sons of Zebedee Church Hall.

c) Report on Workshop Attended in Ripon: Francis Ferguson reported that the board, clerk and treasurer had attended a Wisconsin Towns Association workshop and he felt that it was very informative.

d) Report on Progress of Ordinance Review Committee: Francis Ferguson reported the committee has a meeting tomorrow night to continue working on ordinance corrections.

e) Board of Review Report – Decision on Re-assessment Requirement for the Town to be in Compliance: No objectors attended the Board of Review. Francis reported that the town is looking at doing a reassessment in 2010. The town’s assessed values are out of compliance and they have two years to get back into compliance. Our Assessor, Scott Borree has recommended that we not wait until the last year to complete the reassessment. Mr. Borree has sent the town two contracts one is for a complete walk thru of all the properties at a cost of $68,000 the second proposal is a computer adjustment for $41,300. The last time the town had a walk thru reassessment was 1997 and a computer fix was done in 2004. David Whitty moved that the town do a walk thru reassessment in 2010 with Borree Appraisal Service, Lowell Boelk seconded. Motion carried with a vote of 3 ayes.

f) Notice of Special Town Meeting for the purpose of Acquiring Adjacent Property: The special meeting to discuss and vote on the purchase of the Helen Betz property will be held September 15th at 7:00 p.m. at the Sons of Zebedee Church Hall. Francis Ferguson passed out an agenda that would be used at the meeting and asked for suggestions. The clerk is to have ballots printed, but no one is sure how many to print.

g) Resolution Regarding Zinke Dairy Farms LLC:
RESOLVED, that the town board has reviewed the report of the State of Wisconsin Department of Agriculture, Trade, and Consumer Protection regarding the sufficiency of the nutrient management plan submitted by Zinke Dairy Farms, LLC.

FURTHER RESOLVED that the town board deems the application of Zinke Dairy Farms, LLC, complete pursuant to ATCP 51 and hereby instructs the Board of Zoning Appeals to conduct a hearing on the issuance of a special use permit.

Motion was made by Francis, seconded by David Whitty, to adopt the resolution as listed above. Motion carried with a vote of 3 ayes.

h) Application for Server License for Kimberly Brown: Lowell Boelk moved to approve the server’s license for Kimberly Brown. David Whitty seconded. Motion carried.

Set date(s) for budget meetings: The first budget meeting will be held Wednesday, September 23 at 1:00 p.m. to look at 2010 budget.

Future Agenda Items:

Correspondence: Francis received an e-mail from John St Peter regarding the Barber property. Lois Towne received a thank you from Hackbarth family. The clerk reported on the Clean Sweep Program being held Friday, November 6th at 12:00 noon to 4:00 p.m. at the fair grounds for persons who wish to get ride of hazardous waste. The town has some things in the garage that could be disposed of. Ron Wendler should take anything he feels should be taken. Ron Wendler reported that American Iron would take tires with and without rims. The town has excess tires to get rid of; some have been dropped off by others. Someone should call Carl at American Iron to find out the process. Lowell volunteered to call.

Next Meeting – October 6, 2009: The meeting will be held one week earlier due to the board attending the Wisconsin Towns Association Convention.


It was moved by David Whitty, seconded by Lowell Boelk, that the meeting be adjourned at 8:10 p.m. Motion carried.
