Board Meeting Minutes
October 6, 2009

Chairman Francis Ferguson called the October meeting to order at 7:00 p.m. at the Byron Town Hall. Present were Chair Francis Ferguson, Supervisors Lowell Boelk and David Whitty, and Clerk Kay Oestreich. The Pledge of Allegiance was recited.
Chair Francis Ferguson read the agenda. A motion was made by Lowell Boelk to approve the agenda as presented. David Whitty seconded the motion. Motion carried.
A motion was made by David Whitty to approve the September 8th minutes as circulated, Lowell Boelk seconded the motion. Motion carried with a vote of 3 ayes.
A motion was made by Lowell Boelk to approve the bills as presented by the clerk with the addition of AT&T, We energy for town hall, Cole Oil and Kathy Rozek. David Whitty seconded the motion. Motion carried with a vote of 3 ayes.
Permits Issued: The clerk reported that 4 building permits were issued in the past month.
Memorial Committee Report: David Whitty reported the committee had 33 people attending the bus trip to the High Ground Memorial Park. He felt it was very interesting and would be nice to do the trip again in the summer when the weather would be better.
Historical Committee Report: The Adopt-A-Highway was scheduled for this past Saturday. Committee is currently working on calendar featuring businesses of the town.
Decisions of Plan Committee - Board of Appeals: None
Public Comments: Larry Wunsch questioned the sequence of events in obtaining a septic system permit and building permit. He reported that property adjacent to him had been a dog kennel with a sanitary permit for the kennel. The town issued a building permit allowing the kennel to be remodeled into a living quarters. Currently there are 5 persons living in the house and the septic system has failed. Larry questioned if a new sanitary permit was issued prior to the building permit. He felt the home would require a larger septic system than the one put in for the kennel. John Laudolff reported that a sanitary permit number has to be issued by the county prior to a building permit being issued. Mr. Wunsch has a concern for the wells in the area. The board was not aware of the problem. Larry will contact Marlin Towne to discuss what permits were issued for the property.
The Water Quality Study is about half way thru the process and should be done by the end of the year. The study will use existing data available and not involve an onsite study. Once the survey is complete a presentation will be given to explain the results. Francis Ferguson read an article on the inability of local government to regulate manure handling because of state regulations. A discussion then took place on manure spreading as it applies to water quality. Policing what is being done is an issue.
It was questioned on how many times the cemetery has been mowed. All the bills have not been turned in and the board is not aware of how many times it was mowed.

a) Review of Budget Balances: Current balance is $115,906.86. Francis Ferguson reported that Lost Arrow road blacktopping is scheduled to start tomorrow.
b) Applications for Plan Commission – Board of Appeals, October 14 Zinke Hearing - Survey Map for Tim & Karen Kelley: The public hearing regarding the Zinke Dairy Farms LLC application for the proposed livestock facility expansion will be held October 14th at the Sons of Zebedee Church Hall.
Tim and Karen Kelley are planning on building an Ice Cream Parlor and are proposing to survey off 1.65 acres located on County Road B. David Whitty moved, seconded by Lowell Boelk to approve the survey map for the Kelley’s. Motion carried with a vote of 3 ayes.
c) Report on Special Meeting held September 15th: Francis reported that the vote to purchase the Betz property was defeated. Francis stated his disappointment that only 66 people attended the meeting. John Laudolff asked if the board wanted the committee to do any follow up or if they were to dissolve. David Whitty felt the committee should stay in tact in the event that the property doesn’t sell.
d) Report on Progress of Ordinance Review Committee: Francis Ferguson reported the committee had done the sub division and town zoning book. The information was taken to the lawyer for review and then a meeting will be held with attorney and the committee. The comprehensive plan has yet to be done. The committee’s next meeting will be October 21st.
e) Set Date for Budget Meeting Workshop: A budget meeting is set for October 27th at 1:00 p.m.
f) Set Date for Possible Special Town Meeting to Exceed and Amend the 2009 Highway Budget, to Cover Unexpected Costs and to Authorize the Town of Byron, for Short Term Borrowing to Cover Highway Short-fall in Budget: Francis Ferguson reported that attorney St Peter indicated that a special meeting would not be required. Francis will clarify the matter with our attorney. The town has spent more than they anticipated on road improvement this year and the budget needs to be amended. The town has a need to complete the lost Arrow Road project to finalize the TRIP application and receive the approved grant. Francis explained the other reasons for the budget shortfall. It was suggested that this meeting could be held 15 minutes prior to the next board meeting. Francis moved to set a tentative date of November 10th at 6:45 to allow the town to exceed the highway budget and authorize short term borrowing. David Seconded. Motion Carried.
g) Lomira Fire Contract: The Lomira Fire Department sent a contract for next years fire protection, at the same cost as last year, of $8,400. Lowell Boelk reported that Brownsville Fire Department indicated they would do this additional area for the same cost they currently charge. David Whitty was concerned about the response to those residences with railroad tracts as a barrier. Lowell Boelk is to contact Brownsville Fire Department to get a bid. Francis moved to table this item to the next meeting, seconded by Lowell Boelk. Motion carried.
It was questioned if we had heard anything further regarding the ambulance fee. Francis reported that Attorney St Peter is working on this. John Ferguson reported on what great response he received from the Fond du Lac Ambulance service. Discussion took place on the proposed increase in fees.
h) Future Agenda Items:
i) Set Date for Budget Hearing: A date for the budget hearing will be set at the budget meeting on October 27th.
j) Correspondence: Francis Ferguson read a letter from Alpha Terra Science regarding site assessment of potentially contaminated properties.

It was moved by Lowell Boelk, seconded by David Whitty, that the meeting be adjourned at 8:35 p.m. Motion carried.
