Board Meeting Minutes
November 10, 2009

Supervisor Lowell Boelk called the November meeting to order at 7:00 p.m. at the Byron Town Hall. Present were Supervisors Lowell Boelk and David Whitty, Treasurer Lois Towne and Clerk Kay Oestreich. The Pledge of Allegiance was recited.
Supervisor Lowell Boelk read the agenda. A motion was made by David Whitty to approve the agenda as presented. Lowell Boelk seconded the motion. Motion carried.
A motion was made by David Whitty to approve the October 6th minutes as circulated, Lowell Boelk seconded the motion. Motion carried with a vote of 2 ayes.
A motion was made by David Whitty to approve the bills as presented by the clerk with the addition of A bill from Serwe Implement Co Inc. Lowell Boelk seconded the motion. Motion carried with a vote of 2 ayes. Lowell Boelk reported that the check for Scott’s Construction would be held until written confirmation is received regarding what they intend to do to fix the construction problems on Lost Arrow Road.
Permits Issued: Marlin Towne reported that 8 building permits were issued in the past month.
Memorial Committee Report: John Ferguson reported that the metal of honor member has been dutifully recognized with an engraving on the memorial. The engravings have been sand blasted and will be closely watched for quality.
Historical Committee Report: Bob Simon reported they will have an open house the first Saturday in December and they will have the calendars ready for sale by then featuring the businesses of the Town of Byron.
Decisions of Plan Committee - Board of Appeals – Decision on Zinke ATCP 51 Livestock Sitting Application: Application was approved for Zinke Dairy Farms Inc.
Public Comments: It was reported that the blacktopping that was done on Lost Arrow Road is in terrible shape and will need to be redone. It was felt that the application of the cold mix by Scott’s Construction was done too late in the fall with not enough warm days to set the road. The town will hold their payment until we get something in writing stating what their intention is to fix the problem. It was suggested that Scott’s post a bond to cover the cost.
A question was asked as to what transpired at the 6:45 meeting. It was reported that it was approved to exceed the 2009 highway budget and allow short term borrowing.

New Business:
a) Review of Budget Balances: Current balance is $12,372.47. Lois Towne reported the highway budget is short $29,000. To receive the TRIP funds of $25,000, the bill to Scott’s Construction needs to be paid and the application for the funds made. Whether the payment could be received in this year’s budget is unknown.
b) Applications for Plan Commission – Board of Appeals, - Barber Brookside Road Development - Survey Maps: The Barber Brookside Road Development is in the hands of Jerald Luedtke, Chairperson for the Board of Appeals.
c) Update on Ordinance Review Committee: David Whitty reported that the committee is meeting tomorrow evening with the attorney to review the changes that are being proposed.
d) Resolution to Exceed Levy Limits: Lowell Boelk read the proposed resolution to exceed levy limits. Lowell Boelk read the resolution to exceed the levy limit for 2010. Lowell moved to exceed the levy limit for 2010 and bring the question to the citizens of the town on November 17th at 7:00 p.m. David Whitty seconded the motion. Motion carried with a vote of two ayes.
e) Fire Department Contracts: Several members of the Brownsville Fire Department were present. Jeff Bloom reported that the department did not have to raise the fees to the town for 2010. They only bring in the money they need. They hold fund raisers, raising $15,000 this past year and they work hard to get fire grants. What the department needs financially is divided by the 4 municipalities they serve. He has heard rumors of changing fire districts. The Brownsville Fire Department would be hurting if ¼ of their funding was cut. They are not trying to take over any of the other fire districts. Jeff felt that what the town is paying for fire protection is in line with other municipalities and that the town is fortunate to be surrounded by many good fire companies. The Brownsville Fire Department is 100% volunteer, while some are paid by call. It was questioned if the town has ¼ of the bill does the town have ¼ of the dwellings and Jeff reported that the Town of Leroy would have less homes than what Byron has. A discussion was held on the practice of some fire departments to assess additional fees to the town after a fire. Jeff reported that fire departments have the right to charge the railroad and for highway accidents with no additional charges to the town. If they can’t obtain funds from the individual they can apply to the state. It was suggested that the Eden Fire Department be questioned on their practice of additional charges. David Whitty moved to accept the contracts for Lomira and Brownsville Fire Departments. Motion was seconded by Lowell Boelk. Motion carried with a vote of two ayes.
f) Discussion and Possible Action on Weight Limits for Town Roads: The item was tabled until after the board can speak with the attorney.
g) Report on Convention Seminars: Dave Whitty reported on the new information that was presented at the Wisconsin Towns Association Convention. New legislation will put more responsibility and funding on the town’s shoulders. Lowell Boelk reported on the dairy tour he attended.
h) Report on Water Quality Meeting with Legislators: David Whitty reported that the water quality study should be ready for a presentation in January.

j) Correspondence: John Ferguson reported that there is a meeting coming up on Parsons Creek November 16th at the Brownsville Community Center at 7:00 p.m.

It was moved by Lowell Boelk, seconded by David Whitty, that the meeting be adjourned at 7:46 p.m. Motion carried.
