Chairman Francis Ferguson called the December meeting to order at 7:00 p.m. at the Byron Town Hall. Present were Chair Francis Ferguson, Supervisors Lowell Boelk and David Whitty, Treasurer Lois Towne and Clerk Kay Oestreich. The Pledge of Allegiance was recited.

Chair Francis Ferguson read the agenda. A motion was made by David Whitty to approve the agenda as presented. Lowell Boelk seconded the motion. Motion carried.

A motion was made by Lowell Boelk to approve the November 10th minutes as circulated, David Whitty seconded the motion. Motion carried with a vote of 3 ayes.

A motion was made by David Whitty to approve the bills as presented by the clerk, Lowell Boelk seconded the motion. Motion carried with a vote of 3 ayes.

Permits Issued: Marlin Towne reported that 1 building permit was issued in the past month.

Memorial Committee Report: The committee is working with the monument company to maintain the quality of the monument.

Historical Committee Report: Halie Hackbarth reported on the open house that was held this past Saturday with a tree lighting ceremony. About 100 people attended and 80 calendars were sold.

Decisions of Plan Committee - Board of Appeals: None

Public Comments: It was questioned whether the town would be interested in purchasing the Byron Center for future town use. Francis Ferguson reported that the property has two written offers currently on the table.

It was asked if the town is contacted when the wind turbans are shut down due to maintenance. Francis Ferguson reported that he has not been contacted in the past.

Lowell Boelk asked if it’s the town’s responsibility to plow the Laudolff subdivision. The town has not taken over the road and it shouldn’t be responsible for plowing without billing the subdivision. Lowell Boelk will talk to the John Laudolff in regard to this matter.

It was suggested that cold mix be placed in a pot hole on Kelley Road north of the Jerry Luedtke property.

Old Business:

Weight Limits on Town Roads The town has a concern with manure tankers traveling on the shoulder of the road which breaks up the road. Attorney St Peter is looking into the feasibility of posting weight limits on these roads. Enforcing the weight limit and strengthening the shoulder during construction were discussed.

New Business:

a) Review of Budget Balances: Current balance is $52,896.58. Francis has written a letter to all of our local & state legislatures requesting a change in the amount that a town can charge for permits under Act 51. Currently the most the town can charge is $1,000 which is not enough to cover the costs the town incurs.

b) Applications for Plan Commission – Board of Appeals: Barber Public Hearing will be December 9, 2009.

c) Update on Ordinance Review Committee: Currently in the hands of the attorney.

d) Agreement with Scott Construction on Lost Arrow Road: Francis reported that he has received a letter from Scotts Construction, Inc regarding the condition of Lost Arrow Road. They have agreed to inspect the road in spring and they will take responsibility for any blacktop patching needed and a sealer will be applied over the entire road at Scotts Construction expense. If any base work needs to be done it will be at the town’s expense.

Francis reported on the cost for salt from the county for this season, sand salt mix is $27.10 and salt is $62.47 plus delivery. A discussion took place on private driveways and businesses that the town plows. The town needs to look into whether the charge of $25.00 is enough to cover costs. Lee Oestreich volunteered to call Rademann’s to find out how they determine costs associated with providing plowing services.

e) Agreement with Assessor Scott Borree: At the special meeting to set the levy limit, the limit was decreased with a suggestion that the town do a mathematical adjustment reassessment rather than a walk thru inspection to save costs. Francis Ferguson contacted Scott Borree who agreed to a two year payment plan for the walk thru reassessment. He then read the agreement that was sent to him from Borree Appraisal Services Inc. It was moved by David Whitty that the town contract with Borree Appraisal to do a walk thru reassessment, paying $5,000 in January of 2010, the balance of the revaluation payment ($63,300) split, paying $47,475 (75%) in 2010 and $15,825 (25%) in 2011. Francis Ferguson second the motion. Motion carried with a vote of 2 ayes and 1 nay.

Francis Ferguson reported on the Wisconsin Department of Revenue proposing to move the assessment from the town level to the county.

f) Approve 2010 Budget: David Whitty moved we approve the 2010 budget as presented at the budget hearing for a total of $655,300.00. Lowell Boelk seconded. Motion carried. (a copy of 2010 budget is posted in the three places and the web site)

g) Discussion and Planning for Annual Christmas Party: The town will have a Christmas Party for employees and committee persons on January 13th, at 7:30 p.m., at the Northwinds Super Club. Francis will make arrangements with Northwinds regarding the buffet menu. Lowell Boelk moved, seconded by David Whitty that those attending pay $20.00 a couple ($10.00 each) with the town paying the balance. Motion carried. Francis will mail the invitations.

h) Names for Election Workers for 2010-2011 Elections: Francis Ferguson read the list of Election Inspectors. Some of the names were removed because of new employment or health issues. Francis moved to appoint the remaining 21, Lowell Boelk seconded. Motion carried.


i) Operator’s License for Ashley Van Egtern: David Whitty moved, seconded by Lowell Boelk, to approve the Operator’s License for Ashley Van Egtern. Motion carried.

j) Future Agenda Items

Correspondence – The town has received a “State of Wisconsin Blue Book” from Representative Richard Spanbauer.

Next Meeting – January 12th

It was moved by Lowell Boelk, seconded by David Whitty, that the meeting be adjourned at 8:30 p.m. Motion carried.
