Town of Byron
Board Meeting Minutes
February 9, 2010

Chairman Francis Ferguson called the February meeting to order at 7:00 p.m. at the Byron Town Hall. Present were Chair Francis Ferguson, Supervisors Lowell Boelk and David Whitty, Treasurer Lois Towne and Clerk Kay Oestreich. The Pledge of Allegiance was recited.
Chair Francis Ferguson read the agenda. A motion was made by Lowell Boelk to approve the agenda as presented. David Whitty seconded the motion. Motion carried.
David Whitty moved to approve the January 12th minutes as circulated, Lowell Boelk seconded the motion. Motion carried with a vote of 3 ayes.
A motion was made by Lowell Boelk to approve paying bills as presented by the clerk with the addition of a bill for We energy, David Whitty seconded the motion. Motion carried with a vote of 3 ayes.
Permits Issued: Marlin Towne reported that one building permit was issued for a garage addition.
Memorial Committee Report: Francis Ferguson reported that tickets are available for the Corned Beef & Cabbage Dinner to be held on March 17th, at the American Legion in Lomira, from 4:00 to 7:30 p.m. Raffle Tickets can also be purchased for $10.00 from any committee member or at the event. All monies will be used for the Veteran’s Memorial.
Historical Committee Report: Tim Hackbarth reported that the next meeting of the Historical Committee will be Monday, February 15th. The committee will also meet to organize the basement area this Saturday. The committee is very grateful to Kurt Kindschuh of Drunk Busters for his purchase of 50 calendars to be given to area nursing home residents.
Decisions of Plan Committee - Board of Appeals: Greg Barber’s application for a cull-du-sac was approved with stipulations. The final plat will be presented to the board when completed.
Public Comments: A question was asked regarding the plowing of private subdivisions and if the town was being compensated for this service. Francis Ferguson reported that they have written agreements with Laudolff Subdivision, Shamrock Court and Boda Lane that the town would plow the road in exchange for the subdivision paying for surfacing. The town is not liable for any damage that may occur. The town won’t take the roads over until they meet the requirements for being a town road.
It was reported that Invenergy does not have a phone number listed in the phone book and could that number be listed in the newsletter. Francis is to get the number to Brenda for publication.
Zinke Dairy Farm has been spreading manure on holidays and Sundays, it was questioned if this was an allowable practice under the permit they had been issued. It was felt that it was stated in the Order Management Plan not in the permit. If someone sees a violation they should report it to the town board.
Later in the meeting Tim Hackbarth found the reference in the Order Management Plan restricting the spreading of manure on holidays and Sundays with the Zinkes giving notice, to all residences within one mile, 3 days in advance of spreading. The permit states that the Order Management Plan has to be followed. It was felt that the restrictions take place once the manure storage facility was built. The board will get clarification on this matter.
Old Business:
a) Follow-up on notice of zoning violation, and auto, tire and junk ordinance violations: The individual on Wildlife Lane has been contacted again by phone this past Saturday by Francis Ferguson. The first letter was mailed on January 6th and unlicensed vehicles have still not been removed. Our attorney has said the next step would be to take this individual to court. The judge can include reimbursement for the town’s costs as a special charge but is not required to do so. It was moved by David Whitty, seconded by Lowell Boelk to proceed with necessary court proceedings with Preston Rumbuc. Motion carried with a vote of three ayes.
b) Report on Ordinance and Comprehensive Plan Review Committee: Their will be a meeting tomorrow evening with the town’s attorney to review the proposed ordinance changes.
c) Weight Limit on Town Roads: It was moved by Lowell Boelk, seconded by Francis Ferguson, to table the matter on weigh limits on town roads. Motion carried.
New Business:
a) Report of UW Geological Survey Ground Water Mapping and notice of public meeting on March 11, at 7:30 p.m.: The mapping has been completed and will be shown and explained at a meeting on March 11th at 7:30 p.m. at the Sons of Zebedee Church Hall. The meeting will be open to all town residents and will be published in the newsletter.
b) Resolution to amend the “Resolution to Establish the Town of Byron Veterans Memorial Committee”: The Memorial Committee has been handling their own check book and acting independently from the town board. Francis talked to Attorney Carol Nawrocki from the Wisconsin Towns Association to be sure the pending resolution was correct. She stated that the Memorial Committee would not be able to act independently without obtaining a tax exempt number. It was suggested that the committee return to the practice of the town clerk and treasurer handling the committees check book and the board approving the bills. The town owns the land the memorial is on and carries the insurance on the memorial. The Historical Committee has its own tax identification number which Tim Hackbarth thought took nine months to obtain and cost around $350. Francis Ferguson moved, seconded by Lowell Boelk to table the issue. Motion carried.
c) Review and approval of reclamation plan for Steger/Pinno sand pit, to be returned to FDL County Code Enforcement: Francis Ferguson could not find the paperwork that needs to be signed. It was suggested that it be brought to the Ordinance and Comprehensive Planning Committee meeting tomorrow evening so all the board members could review the paperwork.
d) Resolution to establish the number of liquor licenses that are allowed in the Town of Byron: Francis Ferguson reported that the town currently has 2 active Class B Liquor Licenses with a potential for 3 additional reserve licenses. Lowell Boelk moved, seconded by David Whitty, to limit the number of licenses to two active and two reserve licenses. Motion carried.
e) Newsletter for the Town: Brenda Hackbarth is currently working on finishing the newsletter and it will be in the mail soon.
f) Latest on DOR proposal for county assessment: Francis Ferguson reported that this is no longer an issue.
g) Report on Towns Association Meeting at Ripon: The entire board attended this meeting to get certified to hold the Board of Review.
h) Copy Machine Up-date: The board has purchased a used copy machine for a cost of $25 from Trinity United Methodist Church.
i) Operators License for Guido’s: It was moved by David Whitty, seconded by Lowell Boelk to approve Operator’s License for Julie Woodley and Natasha Milewski. Motion carried.
j) Future Agenda Items:
Lowell Boelk reported that the town has an agreement with the Humane Society to accept dogs but not cats. Anyone taking stray cats to the Humane Society would have to pay the fees themselves.
Current budget balance is $101,737.88.
Correspondence – The clerk has received letters in response to the town’s opposition to DOR Proposal for County Assessment from the State of Wisconsin and Richard Spanbaurer.
